Terms of Use

1. Acceptance of terms
These Terms of Use ("Terms") govern your access to and use of Healable's website, web application and related services (the "Services"). By creating an account or using the Services you agree to these Terms. If you do not agree, do not use the Services.
2. Who can use Healable
The Services are intended for licensed mental health practitioners and their authorized staff. You confirm that you have the legal right and professional authority to use the Services in your jurisdiction and to handle the information you enter.
3. Your account
You are responsible for the activity that happens under your account. Keep your credentials confidential, use a strong password, and notify us promptly if you suspect unauthorized access.
4. Clinical responsibility
Healable provides tools to assist with documentation, scheduling and billing. You remain solely responsible for the clinical care of your clients, for the accuracy of records you create, and for any decisions you make using AI generated content. AI suggestions must be reviewed by a qualified clinician before being used as part of a clinical record.
5. Acceptable use
You agree not to:
- Use the Services to violate any law or third party right.
- Attempt to access another customer's account or data.
- Reverse engineer, scrape, or interfere with the Services.
- Upload malicious code or content that infringes intellectual property.
- Use the Services to provide care you are not licensed to provide.
6. Your content
You retain ownership of the content you and your clients submit. You grant Healable a limited license to host, process and display that content as needed to provide the Services. We will handle Protected Health Information in accordance with our Privacy Policy and any Business Associate Agreement in place.
7. Fees and billing
Paid plans are billed in advance on a recurring basis. Fees are non refundable except where required by law. We may change pricing with reasonable notice; new pricing takes effect at the start of your next billing period.
8. Third party services
The Services may integrate with third party providers such as payment processors, video conferencing and calendar services. Your use of those providers is governed by their own terms.
9. Suspension and termination
You may cancel your account at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or create risk to the Services or other users. On termination we will make a reasonable effort to allow you to export your data for a limited period before deletion.
10. Disclaimers
The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Healable does not provide medical advice and is not a substitute for clinical judgment.
11. Limitation of liability
To the maximum extent permitted by law, Healable's total liability for any claim arising out of or relating to the Services is limited to the amount you paid us in the twelve months preceding the claim. Healable is not liable for indirect, incidental, special, consequential or punitive damages.
12. Indemnification
You agree to indemnify and hold Healable harmless from claims arising out of your use of the Services, your content, or your violation of these Terms or applicable law.
13. Changes to the Services or Terms
We may modify the Services and these Terms over time. If we make material changes we will notify you in the application or by email. Your continued use after the changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which Healable is established, without regard to conflict of laws rules. Disputes will be resolved in the competent courts of that jurisdiction.
